"User" means you, the user of the Website.
"Products" means any goods or services purchased or otherwise obtained by you as a result of your responding to any advertizement or offer contained within this Website or any website linked from this Website.
"Website" means the Internet shopping site known as QPresenter.com, published on the World Wide Web, to which these conditions apply.
"Website Materials" means the materials used in the Website.
"You" means the User

QPresenter's Status
QPresenter is a commercial software package offering for free evaluation and/or sale.

Responsibility and warranties
Di assumes no responsibility for reviewing the contents of the Website Materials and makes no warranty or representation in respect thereof including without limitation as to the content, quality, accuracy, completeness or suitability of any Website Materials viewed for any purpose.

Accuracy and completeness
Although Di strives to provide information that is useful, it cannot ensure the accuracy of all the information at all times not least because of content that may be uploaded by users beyond its control. Therefore you must not rely on the Website in situations where its accuracy or otherwise would cause you to suffer any loss.

Intellectual Property
The Website Materials are protected by copyright, trademark and other intellectual property rights. You must not, and must not permit anyone else to, copy, adapt, modify, transmit, distribute, perform, play or show in public, broadcast or publish any part of the Website Materials, and the Website Materials may only be used for your own private purposes.

Use of Website
The Website must not be used for any purpose that is unlawful or prohibited by these terms of use.

These conditions contain the whole agreement between the parties and supersede all previous written or oral agreements relating to its subject matter other than in respect of any fraudulent misrepresentation which may have been made.

In no event will Di, its suppliers or representatives be liable for any lost revenue, profit, business, anticipated savings, data, or for special, indirect, consequential, incidental, or punitive damages however caused and regardless of the theory of liability arising out of the use of or inability to use this Website or any of the software obtainable thereon even if Di or its suppliers have been advised of the possibility of such damages save for death or personal injury resulting from Di's negligence. In no event shall Di’s or its suppliers' liability to you, whether in contract, tort (including negligence) or otherwise, exceed the price paid by you. The foregoing limitations shall apply even if our warranty fails of its essential purpose.

Our warranty does not apply to any beta-test software, any software made available for testing or demonstration purposes (including 30-day evaluation copies), any temporary software modules or any software for which Di does not receive a license fee. All such software products are provided AS IS without any warranty whatsoever.

Fitness for Purpose
Di assumes no responsibility for Fitness for Purpose of its Website or software. The user agrees that it is their own responsibility to test and ascertain fitness for purpose of this Website and/or any software it embodies. A 14-day free trial of the software package known as ‘QPresenter’ is available for such testing and in purchasing software from Di you agree that you have carefull evaluated the software and that it is wholly suitable for the purpose you intend.

Security Disclaimer
QPresenter Professional can apply rudimentary encryption techniques to help protect the content of presentations. This encryption is intended to deter normal users only and we do not claim a degree of security that is rigorous, such as that offered by DES 3 or other public key encryption methods. Users with particularly stringent security requirements should satisfy themselves that QPresenter Pro offers adequate protection or purchase a specialist encryption solution.

In the event that users decide to save an encrypted presentation using QPresenter Pro, users are reminded to make a careful note of the Administrator password used since it is not possible to make alterations to a presentation without the password.

It is a condition of using the QPresenter and QPresenter Pro licensed software packages that users hold Digital Image Ltd. harmless from any issues concerning loss or corruption of data, howsoever caused.

Termination
Your agreement to these terms is effective until terminated. You may terminate your agreement at any time by destroying all copies of our software including any documentation and leaving this Website. This agreement will terminate immediately without notice from Di if you fail to comply with any provision of this Legal Disclaimer or any provision of the use of this Website. Upon termination, you must destroy all copies of the software.

Law of England and Wales
This Contract is governed by the law of England and Wales and subject to the jurisdiction of the English Courts. Use of this Website is unauthorized in any jurisdiction that does not give effect to this clause
